Welcome to MAKINGWITHMAMI! Our mission is to provide you with unique, high-quality, and inspiring digital designs. To achieve this, we embrace cutting-edge technology as a core part of our creative process. This policy outlines how we use Artificial Intelligence (AI) to create our products and the terms that govern their use, ensuring transparency for our customers and legal protection for our brand.

2. Our Use of AI in the Design Process

MAKINGWITHMAMI utilizes a variety of advanced AI tools to assist in the creation, enhancement, and optimization of our designs. Our creative process is a partnership between human direction and artificial intelligence.

  • Tools We Use: Our workflow may include, but is not limited to, AI platforms such as Adobe Firefly, Photoleap, Leonardo AI, Midjourney, and generative text models like ChatGPT for brainstorming and descriptive content.

  • How We Use Them: AI is used for generating initial concepts, creating unique design elements, enhancing image quality, and exploring creative variations. Every final design is the result of significant human curation, editing, and creative composition to ensure it meets our high standards of quality and originality.

3. Copyright and Ownership of Designs

  • Ownership: All final design compositions available for purchase on any MAKINGWITHMAMI platform are the exclusive intellectual property of MAKINGWITHMAMI. While we use AI tools, the final, unique artwork is a result of our distinct creative direction, arrangement, and refinement.

  • Customer License: When you purchase a design from us, you are purchasing a license to use that design according to the terms specified in this policy and the product listing. You are not purchasing the copyright or ownership of the design itself.

4. Permitted Use of Our Designs (License Terms)

Your purchase includes a license for both personal and limited commercial use, as defined below.

  • Personal Use: You may use our designs for any personal projects that are not for sale or profit (e.g., personal gifts, home decor, DIY projects).

  • Small Business Commercial Use: You are permitted to create and sell up to 200 physical products (e.g., shirts, mugs, signs) per design.

  • Extended Commercial License: For selling more than 200 units, or for use on Print-on-Demand (POD) platforms like Printify or Printful, you must purchase our Unlimited Commercial License, available separately in our shop.

5. STRICTLY PROHIBITED USES

The following actions are strictly prohibited under any license:

  • You may NOT resell, share, trade, or distribute the digital files themselves. This includes uploading our files to any other website or sharing them with others.

  • You may NOT claim the design as your own.

  • You may NOT use our designs to create new digital files for sale. (e.g., you cannot use our rose SVG to create a new floral digital bundle to sell).

  • You may NOT alter the design and claim it as your own.

Violation of these terms will result in immediate revocation of your license and may result in legal action.

6. Our Commitment to Legal & Ethical Standards

To protect our business and our customers, we adhere to the following principles:

  • Prompting Integrity: We have a strict internal policy against using prompts that are intended to replicate the specific, protected intellectual property of other artists, brands, or copyrighted characters. Our goal is originality.

  • Adherence to AI Platform Terms: We abide by the terms of service for every AI platform we use, including their policies on commercial use and content generation.

  • Evolving Legal Landscape: The laws and ethics surrounding AI-generated content are new and constantly evolving. MAKINGWITHMAMI is committed to staying informed and will adapt our policies as necessary to remain in full compliance with legal standards.

7. Legal Disclaimer & Limitation of Liability

  • "As-Is" Basis: All digital files are provided on an "as-is" basis. MAKINGWITHMAMI makes no warranties regarding the performance or compatibility of files with every possible software or cutting machine. It is the buyer's responsibility to ensure compatibility.

  • Limitation of Liability: In no event shall MAKINGWITHMAMI be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on our website, even if we have been notified orally or in writing of the possibility of such damage. In any case, our maximum liability to you shall not exceed the amount you paid for the product.

  • Indemnification: You agree to indemnify, defend, and hold harmless MAKINGWITHMAMI from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of our designs in violation of these terms.

By purchasing a product from MAKINGWITHMAMI, you acknowledge that you have read, understood, and agree to be bound by the terms of this policy.
